AZ Certified Legal Document Preparers (AZCLDP)

Arizona is the only state in the nation that offers a certification program through their Supreme Court system. A Certified Legal Document Preparer is defined under Arizona Supreme Court’s Rule 31, and the Arizona Code of Judicial Administration § 7-201 and § 7-208.

Certification is difficult and strict guidelines and continuing education are required to keep one’s certification. Once certified, a Legal Document Preparer is not required to work under the supervision of an attorney, but is instead bound by the rules, laws, and direction of the Arizona Supreme Court.

Fees charged by Certified Legal Document Preparers generally are more affordable than if one uses the services of an Attorney. However, Certified Legal Document Preparers cannot provide any legal advice. Fees charged by Infinity Legal do not include costs incurred to the client such as court costs, filing fees, services fees, etc.

A Certified Legal Document Preparer, as well as a paralegal, is not permitted to provide any type of legal advice or opinion nor represent the public in court, and all communications with me, while strictly confidential, are not privileged (there is no Attorney-Client privilege). Under the Arizona Supreme Court Legal Document Preparer program, Arizona Code of Judicial Administration (ACJA) Section 5 (C): A Legal Document Preparer shall not provide any kind of advice, opinion or recommendation to a consumer about possible legal rights, remedies, defenses, options, or strategies. A Certified Legal Document Preparer is not an Attorney, is not employed by an Attorney, is unable to provide legal advice or opinion of any kind, cannot represent the public in court, and all communications with a Certified Legal Document Preparer, while strictly confidential, is not privileged.

Furthermore, if you have already obtained the services of an Attorney, a Certified Legal Document Preparer cannot work with you at the same time. In Arizona, all Certified Legal Document Preparers must be certified through the Arizona Supreme Court Legal Document Preparer Program and maintain 10 hours of continuing legal education each year.
